Snapvyn Terms and Conditions

1. Introduction

Snapvyn is an event photo and memory-sharing platform operated by Snapvyn (Pvt) Ltd.. It allows hosts, couples, organizers, planners, companies, hotels, and guests to create event pages, share QR codes or invite links, collect guest-uploaded photos and videos, display memories, and receive post-event media delivery, including AI-assisted highlight features where available.

By accessing, registering for, purchasing, activating, uploading to, viewing, or otherwise using Snapvyn, you agree to these Terms and Conditions. If you do not agree to these terms, you must not use the platform.

2. Key Definitions

• "Snapvyn", "we", "our", and "us" refer to the platform, website, services, and business operated by Snapvyn (Pvt) Ltd..
• "User" means anyone accessing or using the platform, including event hosts, guests, uploaders, planners, managers, organizers, and account holders.
• "Host" means the person, couple, planner, company, hotel, photographer, or entity creating, managing, purchasing, or activating an event.
• "Guest" means a person scanning an event QR code, opening an invitation link, viewing an event gallery, uploading content, or otherwise interacting with an event.
• "Draft Event" means an event that has been created but not activated and is not open to guests.
• "Activated Event" means an event opened to guests under the Free plan, a Silver, Gold, or Platinum event pass, or an Organizer subscription.
• "Uploaded Content" includes photographs, videos, captions, comments, reactions, audio, guestbook entries, and other files submitted through Snapvyn.
• "AI Features" means optional tools that assist with organizing media, selecting content, detecting duplicates or quality issues, creating albums, producing highlight videos, or generating slideshows.

3. Eligibility

You must be at least 18 years old to create an account, purchase a plan, activate an event, or act as an event host.

Guests under 18 may only use the platform with permission from a parent, guardian, event host, or responsible adult. By accessing or uploading to Snapvyn, you confirm that you have the legal capacity to agree to these terms.

4. Account Registration and Security

Snapvyn is not liable for any loss, misuse, deletion, unauthorized access, or damages resulting from your failure to safeguard your account credentials.

• You must provide accurate, current, and complete account information during registration.
• You are solely responsible for maintaining the confidentiality of your login credentials.
• You must not share administrative credentials or unauthorized account access with third parties.
• You must notify us immediately at snapvyn@gmail.com if you suspect unauthorized access or security compromises.
• You accept full responsibility for all activities that occur under your account.

5. Free Plan

• Verified hosts may create unlimited draft events and activate their first event without payment.
• A Free event allows up to 10 guests, 5 uploads per guest, and 50 uploads in total, with media retained for 30 days after the event ends.
• Further activations, higher limits, longer retention, and paid features require an event pass or an Organizer subscription.

6. Event Activation

An event must be activated before guests can join or upload. Activation is covered by the Free plan for your first event, or by an event pass or Organizer entitlement for later events.

Until activation, the event remains a draft and does not accept guest joins, uploads, or post-event delivery.

7. Pricing and Packages

Prices, limits, retention periods, and included features are shown on the pricing page and at checkout, and apply as displayed at the time of purchase unless custom pricing is agreed in writing. Package limits are enforced by the platform.

• Free: one activated event with the limits described in section 5.
• Silver, Gold, and Platinum event passes: one-time payments that activate a single event with the guest, upload, retention, and feature allowances shown for that pass.
• Organizer: a monthly subscription for planners, photographers, venues, and agencies that covers events in an organizer workspace, team roles, and branding controls.

8. Payments and Invoicing

Payments in Sri Lankan rupees are processed by Payments.lk. Payments in US dollars and Organizer subscriptions are processed by Creem. Snapvyn activates a package only after the payment provider confirms the payment.

• You agree to pay the stated fees and provide valid billing information.
• You authorize our payment processors to charge your payment method for one-time passes or recurring subscriptions.
• You are responsible for any bank fees, foreign currency conversion fees, service charges, or applicable taxes.
• Snapvyn does not store full credit or debit card numbers on its servers; payment transactions are secured directly by our payment partners.

9. Subscription Terms and Renewal

The Organizer subscription is billed monthly unless agreed otherwise. By subscribing, you authorize recurring charges until cancellation.

You may cancel at any time through your billing settings before the renewal date. If payment fails, Snapvyn may suspend organizer workspace activation, branding, and team privileges. Events already activated keep their content for their retention period.

10. Refund Policy

Because Snapvyn provides digital services and immediate infrastructure provisioning, payments are generally non-refundable once an event pass has been activated, guest access has been opened, QR codes have been distributed, or media has been uploaded.

• Refund eligibility: Refunds may be considered for duplicate charges, incorrect platform billing, or verified platform-side technical failures that permanently prevented paid event usage.
• Non-refundable circumstances: Change of mind, event cancellation by the host, low guest attendance, venue connectivity issues, failure to display or share QR codes, user error, or dissatisfaction with AI-generated previews do not qualify for a refund.
• Submitting a request: All refund inquiries must be submitted to snapvyn@gmail.com within 7 days of the charge, including payment reference details and the reason for the request.

11. Event Host Responsibilities

Snapvyn acts solely as a technical intermediary and platform provider. Hosts bear sole responsibility for conducting their events lawfully.

• Ensure proper event configuration, date setting, and visibility selection before sharing access.
• Inform guests that Snapvyn is being used to collect and share event photographs and videos.
• Communicate clearly whether the gallery is public, private, or moderated.
• Distribute QR codes, invitation links, and passwords responsibly to intended participants only.
• Actively moderate guest uploads where moderation tools are enabled.
• Ensure all necessary permissions, consents, and rights are obtained from participants before publishing or downloading event media.
• Avoid hosting events that violate criminal laws, data privacy statutes, intellectual property rights, or the rights of any individual.

12. Guest Responsibilities

• Guests must only upload photographs, videos, audio, or comments that they have created or have explicit authorization to submit.
• Uploaded content must not infringe upon copyright, trademarks, privacy rights, publicity rights, or personal data rights of others.
• Content must be respectful and appropriate for the event context.
• Guests must never upload illegal, defamatory, obscene, harassing, fraudulent, or harmful content.
• Guests acknowledge that event hosts have administrative control over the gallery and may view, approve, reject, hide, download, or delete uploaded media.

13. Content Ownership and Platform License

Users retain all existing copyright and ownership rights in the photographs, videos, and media they upload to Snapvyn. Snapvyn does not claim ownership of user content.

By submitting content to Snapvyn, you grant Snapvyn a worldwide, non-exclusive, royalty-free, limited license to host, store, cache, compress, resize, format, display, distribute within authorized event scopes, generate previews, create downloadable archives, provide AI curation, and perform necessary technical operations solely to operate, secure, and deliver the service.

14. Gallery Visibility and Access Controls

In a Public Gallery mode, approved or uploaded photographs and videos may be viewed by other guests, attendees, and persons possessing the event link or QR token.

In a Private Gallery mode, guests are restricted from viewing other attendees' uploads, and media is accessible exclusively to the host and authorized managers.

Hosts are solely responsible for selecting the correct privacy mode prior to inviting guests. Snapvyn is not liable for unauthorized disclosure resulting from a host selecting public mode or distributing access credentials publicly.

15. Screenshots, Screen Recording and Content Capturing

Snapvyn provides platform access controls intended to restrict event access to authorized attendees.

However, Snapvyn cannot technically block native device screenshots, screen recordings, photography of displays, or external capture mechanisms available on user devices.

The ability to view content on a screen does not grant any permission, license, or right to screenshot, record, photograph, scrape, reproduce, repost, distribute, or commercially exploit another person's likeness, photos, videos, or memories.

Unauthorized capturing, publishing, or distribution of event content constitutes a material violation of these Terms, privacy rights, and applicable intellectual property laws.

16. Downloads and Media Access Permissions

Snapvyn does not grant unrestricted public downloading of private event media. The capability to download original files, high-resolution media, ZIP archives, or delivery packages depends on host-configured permissions, user roles, and plan package limits.

Viewing access alone does not grant a right or platform functionality to download source media files.

Individuals without verified event access are strictly prohibited from downloading or accessing event media. Users who legitimately download media are solely responsible for its subsequent use, storage, and distribution.

17. Prohibited Sexual, Pornographic and Harmful Content

Snapvyn is strictly an event celebration and memory-sharing platform. We maintain zero tolerance for adult, sexually explicit, or exploitative material.

Events must not be created, organized, or operated on Snapvyn for the purpose of producing, collecting, sharing, displaying, promoting, or storing sexually explicit or pornographic content.

• Pornographic material, sexually explicit photographs or videos, and adult entertainment content are strictly prohibited.
• Nude or substantially nude imagery is prohibited.
• Sexual exploitation material, non-consensual sexual content, and revenge imagery are strictly prohibited.
• Any sexual or exploitative content involving or appearing to involve a minor (CSAM) is strictly prohibited.
• Malware, viruses, trojans, ransomware, phishing, or other malicious code is strictly prohibited.
• Hate speech, harassment, threats of violence, or defamatory material are strictly prohibited.

Violations will result in immediate removal of content, immediate suspension or termination of events and accounts, and reporting to relevant law enforcement and child protection authorities where required or permitted by law.

18. Content Reporting, Flagging and Moderation

Snapvyn employs automated detection mechanisms, host moderation queues, user reporting features, and administrative review to identify prohibited material.

Snapvyn reserves the right to immediately take down flagged content, disable uploads, mute guests, terminate events, or ban users who violate platform policies.

Users and participants may report objectionable content or request urgent takedowns by emailing snapvyn@gmail.com with the event URL and media details.

19. AI-Generated Features and Live Displays

Optional AI tools (such as highlight reels, photo curation, stories, and summaries) are automated aids provided for convenience. Output quality, styling, and accuracy may vary depending on upload lighting, resolution, and volume.

Hosts are advised to review AI-generated reels and albums before broad public presentation.

Live Wall and projected display features are operated and supervised by the event host. Hosts must monitor real-time submissions when using public screens.

20. Storage, Retention, and Delivery

Storage limits and retention periods correspond to the purchased package. When an event's retention period expires, event media may be permanently deleted and guest records anonymized.

Hosts are responsible for downloading all desired photos, videos, and delivery archives before gallery expiration.

White-label branding (available on eligible plans) allows custom styling, but users may not claim intellectual ownership of Snapvyn software or remove required legal disclosures.

21. Intellectual Property and Third-Party Services

All proprietary software, code, designs, algorithms, trademarks, and interfaces of Snapvyn remain the exclusive property of Snapvyn (Pvt) Ltd. and its licensors. Purchasing a package conveys a limited service license, not an ownership transfer.

You may not decompile, reverse engineer, scrape, copy, or redistribute the platform software.

Snapvyn relies on trusted cloud hosting, payment, storage, and infrastructure vendors. We are not liable for outages, delays, or service interruptions caused by third-party infrastructure.

22. Availability, Security, and Privacy

Snapvyn is provided on an "as is" and "as available" basis. While we strive for high uptime and robust security, we do not guarantee uninterrupted, error-free, or permanent operation.

We implement industry-standard encryption, access scoping, and operational monitoring. Personal data processing is governed by our Privacy Policy.

23. Suspension, Termination, and Cancellation

We may suspend or terminate your account, event access, or services immediately if you violate these Terms, fail to pay required fees, upload prohibited content, infringe third-party rights, or pose a security risk.

Hosts may cancel recurring subscriptions at any time through their account dashboard. Single-event passes expire automatically at the conclusion of their retention period.

24. Platform Disclaimers

• Snapvyn does not guarantee that every guest will upload content or scan QR codes.
• Snapvyn does not guarantee that guest camera hardware, venue cellular connectivity, or file formats will perform without issue.
• Snapvyn is not a permanent archiving facility and should not replace professional photography backups.
• Snapvyn does not guarantee that AI-curated outputs will meet individual artistic or commercial expectations.

25. Limitation of Liability and Indemnification

To the maximum extent permitted by applicable law, Snapvyn (Pvt) Ltd., its directors, officers, employees, and agents shall not be liable for any indirect, incidental, punitive, consequential, or special damages, including loss of data, loss of memories, emotional distress, lost profits, or event disruptions.

Where liability cannot be lawfully excluded, Snapvyn's total cumulative liability is strictly limited to the amount paid by you for the specific event pass or the most recent monthly subscription fee.

You agree to indemnify, defend, and hold harmless Snapvyn (Pvt) Ltd. from any claims, liabilities, damages, losses, and legal expenses arising out of your breach of these Terms, your event, your content, guest uploads to your event, or violations of privacy or intellectual property rights.

26. Governing Law, Dispute Resolution, and Entire Agreement

These Terms are governed by and construed in accordance with the laws of Sri Lanka, including the Personal Data Protection Act (PDPA) No. 9 of 2022, Electronic Transactions Act No. 19 of 2006, and Computer Crime Act No. 24 of 2007.

Any disputes arising under these Terms shall first be submitted in writing to snapvyn@gmail.com for amicable resolution in good faith. If unresolved within 30 days, disputes shall be subject to the exclusive jurisdiction of the competent courts of Sri Lanka.

These Terms, together with our Privacy Policy and applicable plan terms, constitute the entire agreement between you and Snapvyn regarding the platform.
